It’s a real shame he can’t control that side of his character, I think he’s got such a lot to offer when he’s not being a dick.

Maybe, but it’s rare for someone to be charged with a violent crime and not be suspended. Not least because this incident allegedly took place whilst Barton was “at work” and representing Fleetwood.

He’s clearly got a loose hinge and has some issues but what surprised me was how he held it together on the pitch for us. He was provoked constantly by players and other fans and didn’t react. The only time we really saw it was against Lincoln and I think many would have reacted to that lump Matt Rheed. Think Dyche deserves a lot of credit for how he managed him when plenty of other managers couldn’t.

Perhaps he saw SD as a father figure (something he didn't appear to have much of with his actual father), and therefore didn't want to let him down and just looked up to him.

ABH is one of the less serious assault charges.
Even with his previous, I very much doubt that he will receive immediate custody if convicted.

Actual Bodily Harm (ABH)
What is Actual Bodily Harm?

Assault causing actual bodily harm (ABH) is a criminal offence under Section 47 of the Offences Against the Person Act. ABH involves assault or battery causing actual physical harm to the victim. The harm does not have to be serious, but must involve more than a shove to sustain a charge of ABH. Harm such as bruises, scratches and bite marks is sufficient.

ABH only requires an intention to apply unlawful force to someone, not an intention to cause actual bodily harm. For instance, if someone pushes the victim who then hits his head against a wall, he will have intended to apply unlawful force and could be charged with ABH – even if he did not intend the victim to hurt their head.

Will there be a prison sentence?
ABH carries a maximum sentence of five years and or a fine (depending on the seriousness of the offence).

For a first offence, a fine and or community order may be imposed. If the offender has previous convictions or if there are aggravating factors, a prison sentence is more likely.

if found guilty what would you be putting forward as mitigating circumstances bearing in mind his previous convictions

Maybe they will if he is convicted. I would suggest it is unlikely before he goes to trial, unless he pleads guilty.

Theres many a smart arse on here

I kno of a few people who have been repeat offenders who havent been to jail for similar incidents but worse than what barton is supposedly done and still not be sent down again. It takes pretty much attempted murder for jail these days.

Barton will get a suspended sentance at the very worse. But he wont even get that

You obviously found or knew the answer, so why not just answer the first time?
I wasn't being arsey. If he's on a suspended sentence he's in trouble, if not then it will depend on various factors.

Sentences can only be suspended for a max of 2 yrs, the 2008 suspension has well expired.

What do you think he did ?

Not sure why anyone is speculating either way tbh when presumably their is only 2 or 3 people who were actually there.
Hopefully he won’t end up in jail or lose his job but it’s no coincidence that trouble follows him around.

Not so long ago, a chap I knew pleaded guilty to assault (he punched someone outside a pub) and got 6 months in prison.

Takes less than you think, people hear GBH and think you ruined someone but i've been charged with a section 20 for a single punch before.
