I would have thought that the officer's action was ultra vires, in any event, as it's possibly on private land.

The people involved ( and the funeral home ) argued that the fag ends were not thrown on the pavement but in the plant pots. Which belong to the funeral home and are private property and not in the litter police's remit.

I see them on the path on the Greenway in Padiham, hiding with their binoculars, hoping to spot someone littering or not picking up dog foul. It's just funny. Like a military operation.
Of course it's wrong to do it and steps need to be taken to enforce it, but it just seems this is a bit of a mad scheme to just let power go to someone's head who has a machine that can print a ticket.

Technically the offence is committed on any land open to air (doesn’t matter if it’s private property). It is a defence if you have the landowners permission. The owner of this business has said that they have permission to use his plant pots as bins so the tickets were cancelled.
I would be embarrassed to have my picture in the paper, holding a ticket, claiming that I used the plant pots outside a funeral home as a bin.

TBH, I have absolutely no problem with them hiding and pouncing to catch dog foulers as that really is disgusting imo, but in the grand scheme of things dropping a fag butt isn't the most serious problem and seems to be an easy way to target people. They should be putting the same amount of effort into catching those chucking the remains of their KFC out the car window!!

Keep hearing people complaining about these litter police targeting x y z group. How they only go after the unfortunate people dropping small fag ends, or targeting people outside work/factories- stop dropping ****, it's simple.
The smokers getting caught throwing one fag end, smoke multiple times a day and clearing don't have a problem dropping their fag ends. It wouldn't be hard to imagine they are the worst litterers going. 'There was not a bin near' - where do people think these crap goes?

I'd say quite a lot if the litter drops into the food, Sir what you like to order? Well I think I'll have the sirloin medium rare & don't forget to include a fag butt I'm not keen on onion rings.
