The Court of Arbitration has dismissed Cardiff City’s appeal and confirmed Emiliano Sala’s transfer was fully completed before his death. Nantes’ claim for first instalment of transfer fee of 6 million Euros upheld.

Why is it only the first installment? Are they due to pay the rest at some point, or is this a settlement that they have agreed to all things considered?

Certainly seems by Cardiff being told to pay costs that they haven't a leg to stand on and should pay up.

Is this to do with insurance? If an expensive commodity is sent somewhere it usually gets insured.

Part of the CSA statement:

"The CAS proceedings only concern the first instalment of the transfer fee in the amount of 6m euro out of the total transfer fee of 17m euro.

"The other instalments were not due at the time of the procedure before the FIFA instances. The CAS Panel also confirmed that it was not for FIFA to entertain the claim of Cardiff City that it was not required to pay any transfer fee to FC Nantes, because FC Nantes could be liable for the Player's death and that such tort claim was to be set off against any payment obligation with respect to the transfer fee."

The articles on the matter only seem to refer to the first instalment. Do we know if they need to make further payments in the future, or was it agreed that they only pay the first instalment?

Or is that a bit nîave?
Assets of such value wouldnt be uninsured. Surely?

Sure Nantes want paying. Fair enough. But technically the insurance would have paid out. So its just a case of passing the insurance money over to Nantes.

Im guessing it isnt that simple.

Apparently they didn't insure him. They're sueing their insurance broker (and this isn't an April Fool, though it sounds like one) because their insurance broker didn't tell them that they needed to add him to the policy. After saying for years that he wasn't their player and they didn't owe the money, they are now saying that they wanted to insure him two days earlier but they didn't know they had to tell the insurance company.

Proper clutching at straws now. Surely anyone with any experience of life at all understands something isn’t insured until it’s added to a policy, unless they thought it worked like a home contents policy and the whole team was insured up to a total value?

It does doesn't it. When I buy insurance I'm always told that I need to tell the relevant company if circumstances change. I don't know if it's for the brokers to show that their clients have been properly informed. Don't we agree to this by the action of signing the documents.

Home contents policies have "per item" coverage as well as total value coverage. If you buy a new £20k music system and someone nicks it, it wouldn't be insured unless the insurance company has been told and the premium adjusted.

Private individuals dealing with big businesses can, to an extent, get away with the defence "I'm an idiot and the big business should have made allowances for me being an idiot". Multi-million pound companies can't.

Before the tragic and avoidable Sala death I actually didn’t mind Cardiff City as a club and the people in the city of Cardiff are on the whole very nice.
However, shortly after the public outpouring of grief they started to try and wriggle out of their obligations to Nantes. They have dragged this on and on and on and the only reason they have now paid this first instalment is so that they can bring players in because they fear relegation is imminent.
I am sure decent Cardiff supporters are embarrassed or ashamed at the shabby and disrespectful way the custodians of their football club are acting.
What we must never forget is that a young talented man needlessly died here and his life was worth far more than the money Cardiff are still trying to wriggle out of paying.

An insurance company won’t pay out if you’re reckless. So putting on a dodgy plane with a pilot who isn’t licensed to make the flight would seem to be reckless.

The fact Cardiff apparently tried to insure him for £20m the day after he died (as reported by the BBC) shows that they knew they were in deep s**t in terms of accountability for the transfer fee.

The cynic in me would suggest it opens up more reasons if a claim was to happen that more excuses & reasons not to pay out are available, although some legal obligation that the customers are equipped with the correct information prior to signing probably does exist making it watertight.

It's utterly ridiculous and embarrassing that Cardiff (or more likely that loon Tan) are still disputing things. The guy was quite clearly their player and whilst totally bizarre, random, unforeseen and not least completely tragic circumstances contrived to lose Cardiff around 6-8 million quid, they just have to suck it up and move on imo. I like to think if it had happened to us we'd have simply accepted it and coughed up and if we hadn't I'd be slagging the club off for it. Decent Cardiff fans are likely cringing.

Did they ever establish which party was at fault here ?

The football agent Willie McKay is by all accounts an odious character. He arranged the flight for Sala but in court he said he only did this because staff at Cardiff were not taking responsibility in sorting this and he was asked to help.

Tragic for the family but never been clear to me who is at fault and whilst you can see a lot of the comments on Twitter saying Cardiff are a disgrace not sure how many people have the detailed knowledge to judge them.

£110m seems a crazy amount but again we are lacking context and details as to what this relates to.

Some of the comments that came out in court which were made by McKay don’t do anything to enhance the reputation of football agents though do they ?!!! Apparently he should not have been involved in the deal as he was declared bankrupt but was doing this deal through his sons company. The lack of regulation in this sector and what agents get away with remains alarming.

I think they have now accepted that Sala was their player because they have run out of courts to appeal to.

Now they have two main points to their argument:

1. The insurance broker is at fault for not telling them that they needed to insure Sala specifically as soon as he was signed.
2. Nantes are at fault because David Henderson had acted as their agent in the transfer and it was Henderson who arranged the flight for Sala and everything he did for Sala was in his capacity as Nantes' agent so it was Nantes' fault.

There's probably a third point which says "there are 8 billion people in this world and every one of them is more at fault than Cardiff were". If they don't get round to sueing you and me, it will be because we aren't insured, not because we aren't at fault.
