Parking charge notice
Parking charge notice
A few weeks ago I went to a wedding evening do near Poynton. Before the wedding myself and my wife met two other friends at a Wetherspoons for a pint and a bite to eat. Apparently the car park had a time limit and doesn’t belong to Wetherspoons, even though the pub is right in the middle of the car park.
Below is the letter that has just welcomed me as I returned from holiday.
Has anyone got any advise as to what to do? Should I call the pub and explain we had a meal etc and this is why we were there a while? Should I just ignore it or should I pay up?
Cheers in advance for any advise

Re: Parking charge notice
Glad that you have alerted me to this as I sometimes park on here when I go to the local blues club.
Not had a problem so far, but will be cautious in future.
Maybe they've just started to do this, as I know they have at Holmes Mill in Clitheroe for instance - I know someone who got stung for £100 there.
One man's loss is another man's gain !!
Cheers

Re: Parking charge notice
I was broken down on the TK Maxx car park in Burnley. 2 hours permitted, returned after 90 minutes and couldn't move my vehicle.
Called the RAC, took them over 2 hours to arrive.
I received a fine. I sent the information including the official RAC transcript to my appeal.
I lost.
I tried again through POPLA the official body set up to deal with these things. Re-submitted all the information, and lost.
Cost me £100. I'm still seething.

Re: Parking charge notice
For starters I would certainly not pay up or ignore it but would definitely call the pub and explain, get the name of the person you speak too and if you don't get satisfaction then tell them that you will contact Tim Martin Weatherspoon's Chairman, explaining that if they don't try and fob you off after asking for his contact details the person may be reported by you for being unhelpful.Inchy wrote: Should I call the pub and explain we had a meal etc and this is why we were there a while? That should do the trick and do let us know how you get on.

You should certainly contact the pub,
But at no stage disclose who was driving.
How was the signage ? Was it clear that there was a time limit on how long you could stay

Tbh I didn’t take any notice of any signs because I have never been to a pub that has a time limit on parking

The driver is irrelevant. They're entitled to hold the owner liable.paulatky wrote:You should certainly contact the pub,

When I've been there, the signage and rules were clear. They don't always but Euro aren't a local cowboy operator. They're likely to have the signage and charge letters right.

Understandable and of course no pub wants to see their car parking facility abused so if you explain to them I'm sure that in terms of customer relations you will get some satisfaction.Inchy wrote:Tbh I didn’t take any notice of any signs because I have never been to a pub that has a time limit on parking
Re: Parking charge notice
The driver is relevant.
To pass liability to keeper certain procedures have to be followed precisely. Parking companies dont always do that correctly.

It's already a "Notice to Keeper" which I thought was standard if there was no ticket attached to the vehicle at the time and it was done via ANPR.paulatky wrote:The driver is relevant.

I`m a moderator at Facebook page fight your private parking invoice join the page and Scan/post up what you`ve received covering any personal details but leaving dates & times visible. ECP are BPA members so our guru Tony Taylor can hopefully sort this for you.Do not mention, even on the fight page who the driver was.

Really?Inchy wrote:Tbh I didn’t take any notice of any signs because I have never been to a pub that has a time limit on parking
You've been extremely lucky. I've found that a large percentage of these types of establishments have some kind of restriction and number plate recognition nowadays, and as often as not they ask you to register your car registration on a screen at the bar (or similar). Once registered you're usually ok so long as you're spending money in there and can provide the receipt, but it's not always obvious what the situation is, so nowadays I invariably ask at the bar on arrival if there are any parking restrictions, or how to register.
The situation at the Queen Vic, (Bank Hall) has been very confusing. For some time you had to buy a ticket for £1, but then got the £1 deducted from your bill on production of receipt. Not been for a while, but I believe now you just register on a screen.

Anything BPA related we can usually kill off. The IPC which is the other supposedly independent body is corrupt as it`s actually run by the parking companies so no one gets any joy appealing to them, they still can be beat but it`s more of a lottery.Zom Zom wrote:I was broken down on the TK Maxx car park in Burnley. 2 hours permitted, returned after 90 minutes and couldn't move my vehicle.

That's because POPLA is simply a puppet of the parking industry and will almost always "check that everything is above board", THEN enforce the fine!!!Zom Zom wrote:I was broken down on the TK Maxx car park in Burnley. 2 hours permitted, returned after 90 minutes and couldn't move my vehicle.

Re: Parking charge notice
The rules surrounding this type of notice have changed considerably over the years and they are almost water tight. I think you're better to 'bite the bullet" and pay it. You could end up with the fine increasing and you'll end up getting worn down with it all.

Had a nightmare parking for the Arsenal match. Free ones full and pay ones closing at 5pm.
Ended up on the site, above The Bridge, that used to be the Fiat garage in town. As I’m parking up I notice a small sign, tight in a corner. You have to have registered online or it’s a £100 excess. Be careful out there. I left sharpish.

Re: Parking charge notice
There's a lot of cr@p posted about parking fines but trust me it is best to pay them. I get sick of reading all the smart ass stuff about ignore it and it will go away. This is happening less and less now. My daughter not long ago got done for parking wrongly on Blackburn station car park (some of it is station some of it something else, some of it is f*ck knows what). Not sure anybody knows the right place to park there. Anyway she took the 'don't pay it because it's not council and they won't pursue it' bloody advice. Not so folks - she ignored a couple of letters as per the 'advice' and wound up with it being passed to a collection service (with added costs). Eventually threatened with court action she paid - £160 for a £30 fine.
Having read up on this since (after reading the accompanying letter from the collection service) it seems that many private parking firms are now following up on these because, contrary to popular belief, they can enforce them and are doing so more and more because of the numbers of people who were ignoring them. Not sure of the details but it follows some test case or other where the parking firm successfully got payment from someone refusing to pay. It would seem that more companies are passing the 'debt' on to collection companies and these barstewards WILL pursue you to the bloody grave.
As a post script, oddly over the years I have got away with not paying 3 parking fines, all were council and all were because I wrote to them about (genuine) mitigating circumstances.

Re: Parking charge notice
Years ago I got a Parking Charge notice from UKPC for “leaving the site” at Millgate in Bury the KFC one. First letter from them £100 next two weeks later £100 next 2 weeks later from DRP - demand for £160 two weeks after another £160 one month later dropped to £128 then one month later Zenith collections offering a reduced settlement of £80 then a month later again offering a reduced £80 settlement but this time threatening court.
I ignored the lot as I was prepared to go to court and after last letter nothing and it is now time barred.
My advice is if you think you have a good case don’t ever get into conversation and be prepared to go to Court

Re: Parking charge notice
As with post 46. My eldest has had one over her head for about 6 years now and we are waiting for them to take her to court. They won’t.
It was a drop off at Liverpool airport. The website still shows the runway apron as a car park, it isn’t. The parking signage approaching the airport is minute and in a no stopping zone. So is totally unreadable. The airport is totally double red lines, whatever the feck that means?
Every situation is different but don’t let them scare you with increased charges.

Apologies Trevor - on re-reading that, it looks like I'm saying I know everything. I didn't mean that - I know this one but there are lots of road signs I'd probably struggle with - I too don't know many of the things that I should before getting behind the wheel!
