The article (from the publication that Johnson used to be editor of) doesn't disprove it in any way. I'd say their reasoning is pretty shonky:
So why did Boris use the gross figure, when the convention is to use the net figure? Simple: it drives the other side quite loopy. They threaten to sue. And as they explode with anger, the discussion turns to how much of British money is spent to the EU – a conversation subject that suits Brexiteers. This tactic worked so effectively in the referendum because their opponents rose to the bait every time.
Was the £350m figure misleading? Yes, if it was spoken of as the net figure. Would the lower figure have been fairer, and got the point across just as well? Of course. But it would not have been as effective as a campaigning tool, because it would have generated less fuss.
I hope he has a better defence than that in court.
Personally I don't like the idea of private prosecutions, it's too open to abuse, but something needs to be done about the level of truthfulness in political debate at the moment. I don't care that much about politicians getting a prediction wrong or not being able to remember figures off the top of their head but when they wilfully misrepresent figures (and particularly after they have been corrected) then they need to be held to account somehow. I'm buggered if I know how though (my personal option would be that the correction has to be given the same prominence as the lie).

Who really gives a flying ... this is all about discrediting him before the leadership election and I for one couldn't care less. I didn't vote leave for any financial reasons and I expect a lot of other voters feel the same but I hope for Gods sake those remainers that can't accept a democratic vote don't start banging on again and before the 'MILLIONS WOULD HAVE VOTED DIFFERENT' crew start moaning, it wouldn't have mattered.

He has a point. It's a huge surprise that a landmark private prosecution wasn't paid for and tried within a day, our courts are normally so swift. It's not as if this story has been in and out of the news for the past couple of years.

The case is a waste of time because it clearly is not a straightforward lie. It is a dubious interpretation of a fact which could be argued either that it is not wholly untrue, or that it is a misinterpretation.
Here's a question. How many Labour politicians have been prosecuted for any comments made about weapons of mass destruction in Iraq? If none, why not? Is it because the war in Iraq was a more trivial issue than the wording on a bus, or is it because this prosecution is a fatuous waste of everybody's time?

Here's a question. How many Labour politicians have been prosecuted for any comments made about weapons of mass destruction in Iraq? If none, why not? Is it because the war in Iraq was a more trivial issue than the wording on a bus, or is it because this prosecution is a fatuous waste of everybody's time?
If you feel so strongly that Boris is innocent or that other politicians are just as bad then why not do something about it like Marcus Ball has.
