Parking charges again

Just had one through the post. £90.

Luckily I distinctly remember paying for the parking as I recall speaking with the parking attendant at the time as we were parking at Lulworth cove before moving to Dursley’s door and he told us we can use the same ticket.

Anyway fine has come through saying ‘incorrectly displayed’. There’s no photo to prove this and I have proof of payment with time stamp on Apple Pay.

Anyone contested one like this before where you have proof of payment.

Proper shysters these parking firms

I wouldnt mind. But you can park for free around the corner on the road rather than pay to park in a dusty rubble filled car park :-(

I am giving up on predictive text haha!

Although do laugh, as when he said we could use the ticket anywhere we did ask him if we could use it at Manchester ECP. He didnt laugh. Thats probably why he ticketed me!

At Tintagel I once passed a ticket on to a bloke that had 4 hours left on it, the attendant stopped me on the way out and said that man can be fined £400 for using that ticket. I said you had better go tell him then and drove off sharpish.

I parked across from from cash and carry carpets / RDA one night game, as I pulled up there was a traffic warden doing his rounds.

I asked him if I can park on the street, and he said that's fine, anytime after 6 is ok, and we are all knocking off now as they finish at 6, and pointed to the offices theywork from about 50 yards away, where 2 other wardens were having a smoke at the fire exit.

So me and the lad thought happy days we can head to miners for a pint and some food.
So at 18:02 we left the car and headed for the pub.

Got back to the car to see a parking ticket, in opening it was issued a matter of minutes later after I'd left.

The ones having the fag had issued it as I went to said offices the next morning where a gent said the 1st warden had got the info wrong, that street was a 18:30 cut off point for free parking not 18:00.

So got is employee number as my description was 100% spot on having had a couple of minutes chat with him about who we were playing etc.

Eventually got overturned on appeal, but I need all sorts of photos, 2 emails and a telephone appeals hearing.

Why the 2 fagging it didnt just tell me I couldnt park there until said time, or he had his info wrong so either park elsewhere or hang on half an hour in your car is anyones guess.

Seems they couldn't wait to slap a fine on.

Suppose some humans just arent cut out to be friendly, helpful, reasonable or have a bit of common sense.

It's much cheaper to catch the bus to Durdle door and walk over the hill to Lulworth cove and catch the bus back.

Ask them for proof the ticket was incorrectly displayed.

Any parking offence requires photographic evidence in the event of legal action.

Has to show image of dash and windows all round.
If it's upside down on the dash it would show in the picture.
The pictures will prove lack of ticket, no disabled badge on display, the car park sign showing offences etc and it being in a parking bay

They also have to leave a certain amount of time between seeing a car with no ticket and then being able to produce the fine.

Used to be 10mins, but in some places its 5mins for a pay and display car park, that's to allow someone time to get change from a nearby shop.

The parking ticket allows you to park at both. You just get a £90 letter in the post haha

Thanks for that. Yes no evidence on the letter.

He has issued the ticket after we left. Because I was speaking with him at the machine. And in the time I started to process the payment he hasnt gone to my car because my mrs was sat in it feeding the little one.

the timestamp when he went to my car coincides with when we had just left too as i have checked my photos that i took on the road down from the car park.

I do have proof i paid. So even if the ticket was incorrectly displayed, hopefuly thats enough. (In fact I have proof of two lots of payment because our friend didnt have a smart phone to pay for their parking).

99% sure I had to use my reg when paying as well.

If the ticket is for “incorrectly displayed” it doesn’t mean you haven’t paid. Where did you stick it or could it have fallen on the floor?

Central Londons a nightmare now regards penalties.Bus Lanes etc. Always park outside and tube in. Use to enjoy whizzing round marble Arch when traffick moved or parking on the Embankment. Happy days

Ive honestly no idea. I know where i want to stick it.

Im almost certain it will have been in the window. But with the wind when opening the door. And what have you who knows. I do know I still had the ticket after i left as I took the car for a valet and that was in the window.

There is no picture with the letter to show where it was or wasnt displayed.

Hopefuly common sense prevails when I provide proof of payment.

Check what time you paid and what time it was issued.

If it was less then 5mins then its probably incorrectly issued.
Less then 10 there's a chance.

Contact them and ask for the photos proving the offence occurred ASAP, as you only have a certain amount of time before the fine doubles.
If they've got no photos then they'd struggle to take it further legally.

Should be about 8 pictures if I remember rightly.

Front windscreen, dashboard to prove no bluebadge, both sides of the car showing side windows, rear window (some people stick them there to be funny), picture of car showing number plate, the sign from the car park showing costs /offence warning, picture showing car in parking bay and if ticket is incorrectly displayed one of that itself proving it.

That's what I used to take to ensure the parking fine couldn't be overturned :lol:

Proof of payment isn't enough unfortunately.

All parking should be made free anywhere within the UK as part of the road tax & private landowners should be able to claim from that.

Public spaces obviously non residential, even if you need to raise the road tax I think all parking should be free within the UK.

The time I paid was before issued. I’ve checked that.

There’s no image on the letter. The price has doubled as they sent it on 13th but it landed yesterday. 28th. :lol:

If it's paid for out of road tax then you aren't saying it should be free, you're just saying that people who never use car parks should pay the same as people who use them every day.

Totally agree. I remember the buzz I used to get driving over Westminster Bridge, down the Embankment, down the King's Road etc.

I know what you mean, I'm saying people shouldn't be worrying about going over & getting fined or clamped or scrambling about for any change, regarding usage disparities it's only the same as a healthy person paying into the system & never needing to go to the hospital or the doctors, can he/she claim any refunds for being healthy, it's just 1 of them things.

Always appeal in Reading its 50p for 20 mins with very poor signage
Always take photos of your car and its position on the road and any signs
Windsor carpark has a clever trick you have to drive in to see the cost and when you realise its £15 you need to pay £4 to exit
This is the same borough that says they are skint.

Didnt kno charges extended to weekend. Submitted a representation

Main problem with this idea being that Road Tax was abolished about 90 years ago.

A lot of cars don't pay any tax at all now as it's based on emissions. Even my 9 year old Golf Tdi is only £30 a year. Not sure that's covering much parking in central Manchester, as much as it'd be easier for me to park right outside the office on Aytoun Street.

Well vehicle excise duty, 2 of the same beast, my idea would be free parking anywhere & at anytime throughout the UK, you shouldn't need to pay at the time nor worry about going over or getting fined or clamped it should be covered in advance. You own a vehicle & drive you should pay an annual parking set fee & that's it or make it completely free, In life with health & other issues people are juggling about things need to be stress free & easier & parking is a nightmare & it doesn't need to be.

Unfortunately it was extended to 7 days a week (except Dec 25th), and until 10pm every evening as part of the govt. package to "bail out" TFL since Covid. The charge also went up 30%.
Typical govt, logic really. "We want you to avoid public transport where possible, but if you go into work by car then we're going to severely penalise you".

You have had a good outcome there. I recently concluded a year long battle with ParkingEye..probably the biggest cowboys in the parking charge market. I got done for being on DW Gym Wigan for 20 minutes. It was last pre season when we played there. They took me all the way to court and a couple of months ago i had to go to Burnley Crown Court to fight it.
Fortunately after stating that i had made every attempt to pay via mobile phone..and having proof... the judge came down on my side and saying in his opinion 20 minutes wasn't excessive for what i had tried to do. I left the car park because the signal was poor and i just couldn't connect or download their app so with no method to pay i left and ended up on the official away car park further away. I only tried to park closer because it was raining quite heavily.
I stuck to my guns and it paid off.

Glad you got sorted but the stress of that must have been worse than the fine.

That said I imagine thats what they want.

I wouldn't say stressed. Annoyed maybe. Most i could lose was 175 and they wanted 100 anyway. It was a point of principle and i wasn't just handing over my hard earned without a fight. I knew i was right and i explained that to the judge and he agreed. Yes it was hassle with statements and gathering the paperwork but there is help online from experienced people. The glow of satisfaction when the judge told me i had won was more than worth it.

Genuine mistake or attempted stitch up? I wonder if these attendants get paid for each successful ticket they issue? Shame you didn’t get to see the ‘photographic evidence’ they reviewed, or maybe you’ve seen everything they have on you (I.e. nothing)!

To be fair I’ve seen the photo. The ticket was in the window. But upside / face down. It was very windy down there. And I was busy feeding and changing and setting up a pram for two babies. So ticket probably blew upside down when I put it in. But at least they’ve seen sense.

Ah ok. The initial fine and subsequent overturning both seem fair enough then.

I've had a ticket blow off the dash while I had the hatch open, luckily I saw it. Now I always check the ticket after the car is locked.

Well done it fighting it. You were lucky you got the judge you did.
Many judges have deemed its the drivers responsibility to check the ticket is displayed properly before leaving the vehicle and have awarded in favour of the parking company.
Google “ flipped tickets”

Also good that you pointed out the most it could ever be is £175 not the £1,000’s some people fear it may run into.

More people should fight these tickets but the great majority just pay up to take “advantage “ of the discount period

That is how they make their money. Scaring people. Of course some will be bang to rights but i wasn't about to pay £100 or even the £60 discount when i had made every attempt to pay and drove off when i realised i couldn't..and just for the sake of 10 minutes argument. The first bit of advice i got was the worst though. "Ignore it"....is just very poor advice these days and just doesn't work anymore with companies like ParkingEye. I did for the first letter but once i realised they had their claws into me I wasn't backing down either.
Their solicitor spoke to me whilst we were outside the courtroom and the judge was making his decision. He said I was likely to win and in my position he'd have fought it too. Clearly sent by the company lawyer to fight on their behalf. Absolute cowboys that are more or less reliant on people just paying up with the first threat letter.
