Re: Ryan Giggs cleared of all charges
A bit more detail (from Telegraph)........
He denied the offences and underwent a month-long trial, which ended last August when the jury failed to reach any verdicts.
Prosecutors then sought and were granted an application for a retrial, scheduled to begin on July 31, after telling Judge Hilary Manley that the complainants were willing to give evidence at a second trial.
But on Tuesday, prosecutor Peter Wright KC told Manchester Crown Court that the Crown Prosecution Service (CPS) was not now proceeding with the case.
Mr Wright said Ms Greville had “indicated an unwillingness” to give evidence in a retrial because giving evidence in the first trial had “taken its toll” on her and her sister. He added: “This is not a decision taken lightly.”
The prosecutor said there was no realistic prospect of conviction on count one, that of coercive and controlling behaviour, and it was no longer in the public interest to proceed to prosecute on the other charges of assault on Ms Greville and her sister.

One unsatisfactory outcome - if that's what this is - does not mean our justice system is broken.
What is the alternative, convicting people on flimsy or trumped up evidence?
You'd hope those days are gone.

The fact that it's almost three years since he was arrested is enough to tell you that this is absolutely to do with our justice system being broken due to chronic underfunding.

Well, virtually everything else has been underfunded but I'm not sure that's relevant here.daveisaclaret wrote: ↑Tue Jul 18, 2023 5:35 pmThe fact that it's almost three years since he was arrested is enough to tell you that this is absolutely to do with our justice system being broken due to chronic underfunding.
If there's not enough evidence to convince a jury, as unfortunate as that may or not be, the accused can't or shouldn't be found guilty.
Re: Ryan Giggs cleared of all charges
I suspect that, like most areas of public life nowadays, more and more funds have been thrown at it with less and less result. Shutting down for covid can't have helped either.daveisaclaret wrote: ↑Tue Jul 18, 2023 5:35 pmThe fact that it's almost three years since he was arrested is enough to tell you that this is absolutely to do with our justice system being broken due to chronic underfunding.

Re: Ryan Giggs cleared of all charges
CPS have withdrawn charges because the alleged victim has pulled out due to the impact the long-lasting case has had on her. Without the alleged victim it becomes much harder to convict and they now don't think there's a realistic chance of conviction, which they did when she was willing to give evidence.evensteadiereddie wrote: ↑Tue Jul 18, 2023 5:38 pmWell, virtually everything else has been underfunded but I'm not sure that's relevant here.

Backlog of cases was 40,000 pre-covid, 60,000 at the height of covid and a little higher now. Covid exacerbated a problem that has existed for a long time.

Re: Ryan Giggs cleared of all charges
In practical terms yes, but it does mean it’ll cast a shadow over his future. The first trial didn’t cast him in a great light. If I believed I wasn’t guilty (as he does) then I’d have preferred a jury to reach that verdict rather than got off because the alleged victim can’t go through with another trial.

Re: Ryan Giggs cleared of all charges
I suspect he'll have to go abroad to countries with, er, a more "1970s" view of this kind of thing
Re: Ryan Giggs cleared of all charges
I think the verdict is that he is a deeply unpleasant man whose actions can't be proved to be criminal. Rather like Mendy, and for that matter like Huw Edwards apparently, the fact that they haven't been proved to be criminal does not mean that they haven't been proved to do horrible things.martin_p wrote: ↑Tue Jul 18, 2023 5:44 pmIn practical terms yes, but it does mean it’ll cast a shadow over his future. There's a difference. Huw Edwards hasn't been charged.
Why?
Because his alleged behaviour is not illegal.
Giggs' alleged behaviour was but the case couldn't be proved.
End of story.

It’s entirely possible that many guilty people haven’t actually faced justice because money was spent in order for them to avoid it.

Our justice system is the best in the world.
It may well be, that in this particular case , you don't agree with the outcome, but that isn't the fault of the justice system.

Re: Ryan Giggs cleared of all charges
Not at all, I'm just presenting the argument that in this country, our justice system still requires evidence for a jury to reach a guilty verdict for someone to be found er, guilty of a crime.
Public opinion or politics, thank God, should have nothing to do with the process.
As you've seen in your apparent diligent reading of the thread, some posters have already suggested, directly or indirectly, that Giggs is a nasty character and even you suggested somehow money has decided the eventual outcome.
My impatience at the idiot who was unable to understand my argument and decided I was a supporter of an alleged rapist is perfectly justified, I feel.

Re: Ryan Giggs cleared of all charges
She should have been prosecuted for withdrawing, wasting police time, I think in some cases if the evidence is there the CPS still press on ahead regardless of the victim, so at some point some convincing evidence must have existed so why the change of heart by the CPS. The justice system is corrupt & influenced by money, anybody else but high profile figures who can afford the best defence, joe public would be behind bars.
Re: Ryan Giggs cleared of all charges
That is quite a statistic and really not fair on people who know they're innocent and have a hearing hanging over them, ditto witnesses, however perhaps the casual disregard for remaining on the right side of the law by demand people has also contributed to the backlog as well as underfunding.daveisaclaret wrote: ↑Tue Jul 18, 2023 5:42 pmBacklog of cases was 40,000 pre-covid, 60,000 at the height of covid and a little higher now. Re: Ryan Giggs cleared of all charges
It’s beyond doubt that our justice system is an absolute clusterf-uck at the moment - and has been for a few years.
Every part of the process is under resourced - and not a little under resourced either…..it’s beyond breaking point.
And I have first hand experience of this in the last few years from a couple of different angles which sit bang in the middle of this mess.
The relevance of this for this case and many others is that it elongates the whole process. And when cases take years to get to trial for a whole multitude they have more chance of breaking down. Sometimes this can be because the evidence doesn’t meet the necessary CPS threshold (this in itself is a whole separate debate as to what has happened in the last few years)
But unfortunately there are many other reasons why cases are breaking down.
Not commenting on the specific Giggs case as I don’t know enough about it and I doubt whether anyone on this thread does either. I do know that if it’s a multi millionaire footballer where the case breaks down then many people will automatically suggest money has changed hands with no clue whatsoever whether it has or not.

Absolutely right, fidel.
One of the above posters has professed in the recent past not to judge people or question their motives unless he's heard from them or met them personally. That seems to have gone out of the window...
Thankfully those entrusted to administer justice appear to have succeeded in this case.
A distasteful outcome,, perhaps, but a damn sight better than the moronic lynch mob mentality.

When you say they are experiencing different outcomes you are just factually incorrect…..but it doesn’t take Einstein to work out that comes as no surprise to anybody on this board.

What is every report stating? As far as I'm aware, they're stating that the complainant doesn't want to continue with the case, due to the stress of the first trial, where a jury couldn't reach a verdict.Jakubclaret wrote: ↑Tue Jul 18, 2023 8:30 pmI do know (not on a 100% basis) but when every single report is basically stating the same thing, I leave my Sherlock Holmes alter ego at home & believe overwhelmingly what's being stated.

Re: Ryan Giggs cleared of all charges
Is it perhaps possible that his accusers have finally got what they initially set out for in making the accusations, that being a bag full of cash?
I’m not close enough to the story to have an opinion either way but I do find it distasteful when, just because someone has a few quid, if they aren’t convicted of a crime it’s immediately deemed that they have paid folk off etc.
It’s quite possible Giggs is innocent and was falsely accused in pursuit of money, it’s also possible that he’s a horrible person and has got lucky……nobody on where knows either way though.

So a woman who possibly was subject to a crime, has her life turned upside down for years and has not got the strength to continue to fight and you want her to be prosecuted. I’ve heard some heartless drivel on here but that is just about the worst. Her mental health is likely irrevocably damaged but you want to now make her the one to blame.Jakubclaret wrote: ↑Tue Jul 18, 2023 7:39 pmShe should have been prosecuted for withdrawing, wasting police time, I think in some cases if the evidence is there the CPS still press on ahead regardless of the victim, so at some point some convincing evidence must have existed so why the change of heart by the CPS.
