Parking question
I know a few people have asked similar questions on here so wondered if anyone could help solve this one.
My wife received a parking charge from Parking Eye relating to a car park in manchester, in which she was supposed to have overstayed on the 13th December. When we looked at the photograph and car details, it isn't her car. Her registration begins MT73 and the one in the photo is MT72. Its also a different model of car - a Renault Zoe something or other, whereas my wifes is a Clio. It would seem someone has entered MT73 instead of MT72 and generated my wifes details, anyway, upshot it, its not her car.
There appears to be absolutely no way of informing these clowns of their mistake, its just kafkaesque. She has to 'appeal' which she did but also seems deranged given there is no charge for her to answer and its starting to soak up unnecessary time. The appeal has come back saying that she has said the plate has been cloned and can she provide proof? Well it hasn't been cloned, its been entered incorrectly, but there is no option to tell them this.
Where do you go with this?

Ignore it.
Let the fools waste their time and energy and other resources chasing up this nonsense.
You don't have to prove anything.
In fact, I'd think about invoicing them for any time you've spent on this.

I'd maybe write them a letter if you've got the time but like eddie says you're not obliged to do much here. Clearly their fault and it can't go anywhere.

Parking eye have been known to take people to court, you used to be able to just ignore their demands (in cases where you were in the wrong)
in this case, you've nothing to answer, if they tried to go to CCJ it would be easy to contest.
i'd write them a letter with the evidence, send it recorded, keep a record and forget about it.

Not your car or reg, I wouldn't even contact them.
It isn't on you to do anything when they are chasing you for something nothing to do with you.

I would always email, as you gave then evidence if pointing out their error.
Someone has mistyped and got your details instead of correct car.
Upload a picture of your reg and car and point out the reg on their picture. That should kill it.

I'd nip it in the bud and tell them they've got the wrong details.
Whilst you ultimately have no case to answer ignoring it will just invite months of demanding letters and ultimately a court date. Then you'd either be forced to contact them with your evidence or go to court.
All this can be avoided with a simple email/letter now

Part of the problem is there is no path to contact them other than via their own ‘appeals’ process.
They have already responded with completely the wrong end of the stick, saying that as she has stated the car has been cloned she needs to provide evidence. As I say it’s kafkaesque.

I would write to them pointing out the error and enclose a copy of your charges. Tell them any future work involved in this action will require payment as stated in my costs listed below.
Writing a letter or email £20.00
Receiving any letter or email £10.00
Attendance in person at any venue £100.00 per hour
Telephone calls £20.00
Any other anomalies £50.00per hour.
Include in your letter an invoice for £20.00, payment of which must be made in 7 days failing which it will attract further interest at 8% plus further costs.
Send it recorded then if they issue a summons you produce your letter and terms to the Court at which point you claim what’s listed above, your also entitled to include your reasonable travelling expenses.

But clearly the car hasn’t been cloned!! How ridiculous. It’s not cloned if it’s a year out on the reg plate, or more importantly, a different Renault model. Bunch of tossers these car park regulators. In all honesty, I would just ignore it. As stated earlier, if they took you to court, you could provide your V5 document to show which is your car.

Have a look at the Knowledge hub. The section 'how is the contract formed with the driver' gives the answer. There is no contract because she was not the driver as they have got the wrong vehicle, end of claim.....
