Surely arrested means there has been the formality of a person being formally read their rights that they are suspected of a crime, and that from that moment on anything said or done can be taken into consideration within the investigation process pending potential charges.
For all we know this all happened accompanied by a pot of tea all round in the Murrays’ lounge, a chat was had, and the HRMC officials then left....

You don’t need to be arrested for that, just cautioned. When you’re arrested you’re taken into custody, ie your liberty has been taken away from you.NRC wrote:Surely arrested means there has been the formality of a person being formally read their rights that they are suspected of a crime, and that from that moment on anything said or done can be taken into consideration within the investigation process pending potential charges.

Any Premier League footballer who isn't involved in tax avoidance should sack their advisers and employ some competent ones. Given the salaries you'd fully expect steps to be taken to minimise the tax bill.turfytopper wrote:Thanks. Which is why I included evasion, which is illegal.....that said some “competent” tax advisors may advise some pretty clever schemes that look a great way of legally avoiding tax....some of these schemes can later be declared as evasion.aggi wrote:Any Premier League footballer who isn't involved in tax avoidance should sack their advisers and employ some competent ones. EG the dodgy film investment scheme:-
Source Financial Times
The Supreme Court today (15 November) ruled against users of a failed tax avoidance film partnership scheme, which tried to use legitimate investment in the film industry as a hook for tax avoidance.
Furthermore all footballers should pay PAYE and NIC (both employee and employers). I say this as they are employed...they cannot by HMRC’s own rules be self employed. They have a contract of employment, they cannot sub contract, they do not provide their own tools, they do not quote for each piece if work, If the HMRC ever lifted the lid on the professional footballer they would crawl all over it.

Obviously planning runs through from simple things like pensions through to highly dubious like dodgy film schemes and registering your jet in the Isle of Man.

Re: Glenn Murray locked up
The most common way for a footballer to avoid tax is to set up an overseas limited company to handle his image rights, and get a large chunk of his "salary" paid by his club to that company. This gives the club the right to use his image as a way of making money - eg. names on shirts, pictures in programmes, etc. It has to be proportionate - if Burnley said they were paying Tom Heaton £10k per year for playing football and £2m for image rights, it would be laughable and would be overturned. But if it was say £1.8m for football and £200k for image rights, it could work. Obviously the clubs like Man U with huge overseas markets could justify larger payments.
If the company is in the UK, it pays tax at about 20% instead of the 47% that an individual pays at top rate (including National Insurance. The club benefits big style as well, because image rights aren't subject to 13% employer's NIC.) But if the company's abroad, eg. Jersey, Bermuda, etc., then the company pays no tax at all and the individual won't be taxed until he brings it back to the UK. If he buys property abroad with it, like Lineker, then he never pays UK tax on it.

Re: Glenn Murray locked up
Indeed. The scale of this came out with the Portsmouth insolvency when it was found that relatively unknown players were receiving huge chunks of money as "image rights" although I seem to remember the test case was Dennis Bergkamp who was having the rights paid back to a company in the Netherlands. HMRC have cracked down on it now and there are guidelines, I think 20% of earnings as image rights is the rule of thumb. Cases are still ongoing at the moment and HMRC are looking into all clubs at the moment.dsr wrote:The most common way for a footballer to avoid tax is to set up an overseas limited company to handle his image rights, and get a large chunk of his "salary" paid by his club to that company. Re: Glenn Murray locked up
Given that this is being progressed on a criminal basis and is being called evasion, it is more likely that this around hidden income as opposed to how the income is classified.
My guess is that this could be around income from property rental or the like which hasn’t been declared and has probably been hidden offshore.
If it was around image rights etc. Then that would be classed as a legal interpretation issue or avoidance and would not be dealt with criminally.

Numerous accusations in the last week that have been unproven apart from how someone views a comment.
Re: Glenn Murray locked up
It usually takes a lot of non-cooperation before the police get involved. Normally when HMRC find underpaid tax, whether avoidance or evasion, they chase the guilty party and impose fines themselves, and it never reaches arrest level.1968claret wrote:Given that this is being progressed on a criminal basis and is being called evasion, it is more likely that this around hidden income as opposed to how the income is classified.

It does, although it's being cracked down on (Hull are in trouble at the moment) with HMRC visiting clubs to specifically review this area.Sidney1st wrote:Still goes on ref unknown players getting image rights etc.

Given the amount of media and so on (U23 games being televised, websites full of profiles on every single player, community work, etc) then there is still a reasonable argument that even players who aren't in the first team should be getting image rights with the Premier league being so high profile.

Wanting somebody to get raped for not paying it is crazy. In fact it is vile although I don't think you have the common sense to have meant what you had written. And most people if they earned enough would follow the lead of the counties wealthiest influences and do the same.
Murray doesn't know his arse from his elbow and would have mearly been advised on how best to invest his money.
Shall we have Messi in the same boat or just his father for taking the wrap for it? We could have 80 % of MP's done as well.
Just admit it was tongue in cheek comment and back away from this one with a smiley and say , yes you are right sir,
